In a recent court ruling, a woman in her 30s received a prison sentence after falsely accusing her biological father, who had financially supported her education abroad, of rape. The accusation followed his refusal to give her more money.
As reported by the legal community on the 1st of the month, the Criminal Division 1 of the Namyangju Branch of the Uijeongbu District Court, presided over by Judge Choi Chi-bong, sentenced a woman, referred to as A, to 10 months in prison. The charges included defamation, business obstruction, and insult.

Between May and June of the previous year, A was tried for posting defamatory content about her father, B, on an online community 11 times, under the title, "I am a victim of familial sexual violence. Please look at this."
In her online statements, she falsely alleged continuous sexual abuse by her father since the age of four, claimed her mother also endured domestic and sexual violence, mentioned a settlement of 30 million won, and called for harsh punishment.
During this process, A disclosed B's real name and business details, reportedly causing operational difficulties for B’s business.
Furthermore, A accused B of remarrying a woman, C, with whom he allegedly had an affair, by posting six times about this claim.

In February 2021, A initiated a damages lawsuit for sexual assault against B at the Incheon District Court. However, she failed to produce evidence of any wrongdoing.
During the criminal proceedings, A maintained the truthfulness of her statements, but the court dismissed her assertions, referencing the lawsuit's outcome. The court noted the lack of concrete evidence or circumstances suggesting habitual sexual assault by B.
Additionally, the court deemed A’s accusations as unfounded, considering B's financial support for her studies and after her return home. The timing of her rape accusation soon after B declined her substantial monetary demand for a cafe venture further reinforced the court's viewpoint.

The court highlighted that A disseminated false information due to frustration over being denied financial support, irreparably damaging the reputations of the victims.
Explaining the rationale behind the sentence, the court considered the high likelihood of A reoffending, as she continued similar postings post-crime, alongside the victims' strong desire for severe punishment. These aspects were thoroughly evaluated in the decision-making process.
